Branding

(a) If you create a work based on the program, you must display a “Powered by OpenSplashTM Technology” graphic for 3 seconds on installation and start-up of your work; and

(b) You must display the “OpenSplashTM Technology” branding with the software and use such branding wherever you convey the program to third parties (if you create a work based on the program, you may call that work whatever you wish, provided that you make it clear that the work is “Powered by OpenSplashTM Technology”).

Use Appropriate OpenSplash Branding” means that the Program or work is clearly, conspicuously and appropriately branded using “OpenSplash” wherever and whenever it is conveyed or information about it is provided (for example, every webpage from which the Program or work is conveyed (in any form), webpage or materials providing an overview or description of the Program or work, all documentation regarding the Program or work, and all other materials and/or mediums on or through which the Program or work is conveyed or described shall be appropriately branded using “OpenSplash”). Appropriate branding using “OpenSplash” for a verbatim copy of the Program means it is referred to as “OpenSplashTM Technology” and the “OpenSplash” trade-mark is used in accordance with the Trade-Mark Guidelines. Appropriate branding using “OpenSplash” for a work based on the Program means that each reference to such work is proximately linked to the phrase “Powered by OpenSplashTM Technology” and the “OpenSplash” trade-mark is used in accordance with the Trade-Mark Guidelines.

On installation and start-up of the work, it must display in the centre of an otherwise black screen for at least 3 seconds the unmodified “Powered by OpenSplashTM Technology” graphic available at http://www.opensplash.net, and in the source code distribution.
